Welcome to ZK Creations! The terms "we", "us" and "our" refer to ZK Creations LLC. ZK Creations operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the "Services"). ZK Creations is powered by Shopify, which enables us to provide the Services to you.
These terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms"), describe your rights and responsibilities when you use the Services.
Please read these Terms of Service carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability.
By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or our Privacy Policy, you should not use or access our Services.

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you have given your consent to allow any of your minor dependents to use the Services on devices you own, purchase or manage.
To use the Services, including accessing or browsing our online store or purchasing any products or services we offer, you may be asked to provide certain information, such as your email address, billing, payment and shipping information. You represent that the information you provide is correct, current and complete and that you have all rights necessary to provide this information.
You are responsible for maintaining the security of your account credentials and for activity conducted through your account.
SECTION 2 - OUR PRODUCTS
We make every reasonable effort to accurately represent our products and services. However, colors and product appearance may vary depending on your display, device settings, lighting, manufacturing process, or materials.
Many ZK Creations products are manufactured using 3D printing. Minor variations in surface texture, layer appearance, color, or other cosmetic characteristics may occur as a normal part of the manufacturing process and do not necessarily constitute a defect.
Product descriptions, specifications and availability may change without notice. We reserve the right to discontinue products or limit quantities available for purchase.
SECTION 3 - ORDERS
When you place an order, you are making an offer to purchase. ZK Creations reserves the right to accept or decline an order where permitted by law. An order is not considered accepted until payment has been successfully processed and the order has been accepted for fulfillment.
Please review your order carefully before submitting it. Because some products may be manufactured or prepared specifically for an order, cancellation requests may not always be possible once production or fulfillment has begun.
If we need to change or cancel an order, we will attempt to contact you using the contact information provided with your order.
Returns and refunds are governed by our Return and Refund Policy.
SECTION 4 - PRICES AND BILLING
Prices, discounts and promotions are subject to change without notice. The price charged will be the price displayed when the order is placed, subject to correction of obvious errors.
Unless otherwise stated, displayed prices do not include applicable sales taxes or shipping charges. Applicable charges will be shown during checkout.
You agree to provide current, complete and accurate purchase and payment information. You represent that you are authorized to use the payment method provided for your purchase.
SECTION 5 - SHIPPING AND DELIVERY
Shipping and delivery dates are estimates and are not guaranteed.
Production and fulfillment times may vary depending on product availability, order volume and manufacturing requirements.
Once an order has been shipped, delivery may be affected by circumstances outside our control, including carrier delays, weather, transportation disruptions or other events.
Customers are responsible for providing an accurate and complete shipping address. If you discover an error in your shipping information, contact us as soon as possible at zvi@zkcreations.com.

SECTION 6 - INTELLECTUAL PROPERTY
Unless otherwise stated, the content and materials provided through the Services, including ZK Creations names, logos, product designs, photographs, graphics, text, videos and other content, are owned by ZK Creations LLC or their respective licensors and are protected by applicable intellectual property laws.
You may use the Services for personal, non-commercial purposes. You may not reproduce, distribute, modify, sell, republish or commercially exploit our content or intellectual property without prior written permission from ZK Creations.
Digital products, including downloadable 3D-printing files such as STL files, are licensed rather than sold except where expressly stated otherwise. Purchasing a digital file does not transfer ownership of the underlying design or intellectual property.
Unless a particular product listing expressly grants additional rights, digital files purchased from ZK Creations are for the purchaser's personal use only and may not be redistributed, shared, resold, uploaded to file-sharing services, or sold as digital files.
SECTION 7 - OPTIONAL TOOLS AND THIRD-PARTY SERVICES
We may provide access to tools, applications or services supplied by third parties. We do not control all aspects of these third-party services and are not responsible for their availability, content or operation.
Your use of third-party tools and services may also be subject to the terms and privacy policies of those third parties.
SECTION 8 - THIRD-PARTY LINKS
The Services may contain links to websites or services operated by third parties. We are not responsible for the content, accuracy, policies, products or services of third-party websites.
If you access a third-party website, you do so subject to that third party's terms and policies.
SECTION 9 - RELATIONSHIP WITH SHOPIFY
ZK Creations is powered by Shopify, which enables us to provide the Services to you. However, purchases made through our store are transactions directly between you and ZK Creations LLC.
Shopify provides the ecommerce platform and related technology used to operate our online store but is not the seller of ZK Creations products.
SECTION 10 - PRIVACY
Personal information collected through the Services is handled in accordance with our Privacy Policy.
Because our store is hosted by Shopify, certain information may also be collected and processed by Shopify and other service providers as necessary to operate the store, process transactions and provide the Services.
SECTION 11 - FEEDBACK AND REVIEWS
If you submit reviews, suggestions, photographs, feedback or other content to us, you represent that you have the right to provide that content and that it does not violate the rights of another person.
You grant ZK Creations permission to use feedback and reviews for purposes related to operating, improving and promoting our products and Services, subject to applicable law.
We reserve the right to remove content that is unlawful, fraudulent, abusive, misleading, infringing or otherwise inappropriate.
SECTION 12 - ERRORS, INACCURACIES AND OMISSIONS
Occasionally, information on our website may contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, shipping charges, transit times or availability.
We reserve the right to correct errors and update information as permitted by law. If an error materially affects an order you have already placed, we will contact you when appropriate.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE."
EXCEPT FOR WARRANTIES THAT CANNOT LEGALLY BE EXCLUDED, ZK CREATIONS DISCLAIMS IMPLIED WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
Nothing in these Terms is intended to eliminate or restrict rights or warranties that cannot legally be waived or excluded.
SECTION 16 - LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ZK CREATIONS LLC AND ITS OWNERS, EMPLOYEES, CONTRACTORS, SERVICE PROVIDERS AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICES OR PRODUCTS PURCHASED THROUGH THE SERVICES.
Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.
SECTION 17 - INDEMNIFICATION
To the extent permitted by applicable law, you agree to indemnify and hold harmless ZK Creations LLC and its affiliates, owners, employees, contractors and service providers from third-party claims arising from your unlawful use of the Services, your violation of these Terms, or your infringement of another person's rights.

If any provision of these Terms is determined to be unlawful, void or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed as necessary. The remaining provisions will remain in effect.

Our failure to enforce a provision of these Terms does not constitute a waiver of that provision.
These Terms, together with the policies referenced through our store, constitute the agreement governing your use of the Services, except where additional terms expressly apply to a particular product or service.
SECTION 20 - ASSIGNMENT
You may not assign your rights or obligations under these Terms without our prior written consent.
We may assign our rights and obligations as permitted by applicable law.
